SJRA Board Meeting Packed by “Stop the Drop” Protesters

More than 150 red-shirted “Stop the Drop” protesters packed the SJRA board meeting at the Lake Conroe Dam this morning. Lake Conroe lakefront homeowners came to protest the seasonal lowering of Lake Conroe. According to SJRA Board Member Mark Micheletti, two and a half busloads of additional angry protesters had to be turned away because they exceeded the building’s capacity.

Five Lake Houston area residents came to speak. However, they were outnumbered by more than 30 to 1. The Lake Houston Area residents made good presentations, but on the basis of numbers alone, the well organized sea of protesters overwhelmed them. The disparity in numbers between the two sides sent a not-so-subtle message to SJRA board members.

Goal of Policy

The SJRA designed the temporary lowering program to provide downstream residents with an extra cushion against flooding until flood mitigation measures in the Lake Houston Area are completed. The measures include dredging and the installation of additional gates on the Lake Houston Dam. This year, the SJRA lowered the Lake Conroe one foot during the rainiest part of Spring and two feet during the peak of Hurricane Season.

Since the policy started in the second half of 2018, no downstream or Lake Conroe residents have flooded because of releases from Lake Conroe.

Misperceptions Abound

Organizers had fed protesters false information. For instance, many protesters claimed:

  • Dredging in the West Fork is done. It isn’t. State Representative Dan Huberty is organizing a follow-on program to supplement the Army Corps program which finished around Labor Day.
  • Because some Kingwood East Fork residents flooded during Imelda, it proves that Lake Conroe has nothing to do with Kingwood flooding. The East and West Forks (which includes Lake Conroe) are in different watersheds. During Imelda, the East Fork received 20 inches of rain while Lake Conroe received only 2.
  • Lake Conroe releases during Harvey comprised just 15% of the water flowing into Lake Houston and that was not a large enough percentage to affect flooding. The statistic may be literally true. But it’s misleading. It has nothing to do with the flooding on the West Fork. And that’s where the vast majority of all damage occurred. Lake Conroe releases comprised ONE THIRD of the water coming down the West Fork. Furthermore, they came at the peak of the flood.

Two More Board Meetings Before Vote

The SJRA board meets again in January and February before voting on whether to extend the seasonal lowering of Lake Conroe another year. The next meeting will be at the The Lonestar Convention & Expo Center so more people can attend.

The board was afraid that if it chose a Lake Houston venue for the meeting, it would look as if they were trying to stifle dissent.

Another meeting like this could mean the end of Lake Houston’s only flood protection measure at the moment.

Plans For Next Phase of Dredging Announced

Behind-the-scenes work for the next phase of dredging has already started. The City, County and State are working together on a $30 million grant application for submission this month. The legislature earmarked the money for dredging at the confluence of the San Jacinto and Lake Houston. However, the money must go through the Texas Water Development Board (TWDB) to Harris County and then the Harris County Flood Control District.

Circuitous Route for Funding

The supplemental appropriations bill, SB500, that the legislature approved dictates the circuitous route for funding. See the exact text from SB500 below.

“Out of funds appropriated in Subsection (1), $30 million is dedicated to the Texas Water Development Board to provide a grant to Harris County for the purchase and operation of equipment to remove accumulated siltation and sediment deposits located at the confluence of the San Jacinto River and Lake Houston.”

DIY vs. Outsourcing

State Representative Dan Huberty, who authored the SB500 amendment, has worked closely with all parties involved to explore the most cost-effective and timely solutions. For instance, Flood Control explored how much it would cost to hire an outside company for dredging versus buying the equipment and doing it themselves. Said Huberty, “In my discussion with the TWDB last week, they have agreed we can buy equipment if we need to, which is the direction we are pushing for at this time.” However, that option would take longer to implement and the money must be spent within the current bi-annum – by law.

Long Term vs. Immediate Needs

Meanwhile, the East and West Forks of the San Jacinto have urgent, immediate dredging needs, too. So the partners could break the work up and pursue both DIY and outsourcing options.

Said Huberty, “I met with DRC (Disaster Recovery Corporation) a week ago. DRC has an ongoing contract with both the City and County for debris removal from Lake Houston and they are still removing debris from the lake. So they might be an option that would let us deploy faster.” 

DRC is the parent company of Callan Marine, a subcontractor during the Army Corps’ Emergency West Fork Dredging project after Hurricane Harvey.

Additional Sources of Funding

Huberty also said that, “In addition to the $30 million, the Houston Mayor Sylvester Turner and Council Member Dave Martin committed last weekend to help us fund this in partnership with Harris County Flood Control.” The City committed approximately $6 million, according to Huberty.

“In addition,” says Huberty, “I spoke to the Governor’s staff this weekend. We still have money left over from Harvey debris removal. That’s approximately another $16 million. They told us we can spend the money on the river and lake, but not for other purposes. This will let us complete the mouth bar dredging and get mechanical dredging done in areas like Huffman and Atascocita. The scope of the project is expanding, which is very good news. We’ll be able to help more people.”

Next Step: Commissioners’ Court Needs to Approve Grant Request

The ball, at this moment, is in Flood Control’s court. Commissioners’ Court must approve all grant requests made by any part of the County. Says Huberty, “There will be an item on the December 17th Commissioners Court agenda requesting permission from the Court to submit the grant application to TWDB. All parties involved have already had discussions with the TWDB staff and are working on the grant application paperwork.”

Early next week Huberty plans to meet with John Blount, the Harris County Engineer; Stephen Costello, the Mayor’s Flood Czar; and John Sullivan, President of DRC.

Constant Dredging for Foreseeable Future

“In my discussions with all interested parties,” said Huberty, “we should have the application submitted by year end. We have been pushing to get it awarded quickly. It is a formality. We need to spend this money quickly which works to our advantage. We can always go back to the legislature for more after that.”

“All of these initiatives will ensure we can have constant, permanent dredging on the Lake for the foreseeable future,” said Huberty. “I am very pleased with the result and look forward to getting this project started.”

Lake Conroe Lowering Benefits MoCo Residents, Too; More Than 1100 Flooded on West Fork During Harvey

Lake Conroe residents organizing opposition to the SJRA’s lake lowering policy have found it easy to “blame” Kingwood for their inconvenience. Kingwood is an affluent community in another county. But the Lake Conroe people ignore more than 1100 homes between Kingwood and Lake Conroe in Montgomery County (MoCo) that also flooded.

The lake lowering reduces downstream flood risk by creating extra capacity within the lake during months with the heaviest rainfall. It is a temporary measure until flood mitigation measures can be completed that help protect the Lake Houston Area.

ESRI GIS Database Shows Counts of Damaged MoCo Homes

ESRI operates a Montgomery County GIS (geographic information system) database called the Harvey Story Map. (Unfortunately, this may not work with all versions of Safari. Try Chrome if you have trouble.) Clicking on Section 12 shows the location of homes that flooded during Harvey in MoCo.

As you to zoom, you can see counts of flooded structures within the visible area. For instance, around Lake Conroe, 292 homes flooded during Harvey. The map below shows the location of those homes.

I’m not sure how many people have waterfront lots on Lake Conroe, but is their boating convenience really worth risking the possibility of flooding even a subset of these homes again?

FAQs About Lowering Lake Conroe to Reduce Downstream Flood Risk

At its February 2020 board meeting, the San Jacinto River Authority (SJRA) Board of Directors will consider NOT lowering Lake Conroe during the spring and fall rainy seasons. Lake Conroe residents have mobilized to protest the lowering which they see as a costly inconvenience. They have started spreading disinformation about the policy. The SJRA Board has reportedly already received more than a hundred letters protesting the policy.

Reason for Lowering and Current Status

The strategy of lowering Lake Conroe on a seasonal basis reduces the risk of flooding downstream residents by increasing the capacity of Lake Conroe to store water. The SJRA Board of Directors and City of Houston review the strategy annually. Both entities own water rights in Lake Conroe.

The gates at Lake Conroe can release water at up too 150,000 CFS but are currently releasing 0 CFS. Lake lowering ended October 1st.

This year’s seasonal lowering of Lake Conroe ended October 1st. However, as of this morning, the lake level is down to 198.77′ MSL (mean feet above sea level). That’s 2-3 inches below the target level for the fall lowering. The lower level is due to evaporation and low rainfall; the SJRA stopped releasing water on October 1.

After Hurricane Harvey, the State of Texas called on the SJRA Board of Directors and the City of Houston to participate in regional strategies to reduce flooding. The temporary lowering of Lake Conroe has reduced  releases from Lake Conroe during storms. SJRA and downstream communities realize and understand the inconvenience that the strategy can create around Lake Conroe. We ask for understanding for the duration of this temporary mitigation strategy.

Seasonal Lake-Lowering FAQs

Who Decides?

The City of Houston and the SJRA collaborate on the decision to temporarily lower Lake Conroe for flood mitigation because it effects the water supply of both entities.

How Long Will It Continue?

Seasonal lake lowering is a temporary flood mitigation initiative to increase the capacity of Lake Conroe to catch rainfall and runoff while long-term and short-term flood mitigation strategies are implemented downstream.

The motion made by the SJRA Board states that the intent of the proposal is to provide “a near-term, temporary flood mitigation benefit while more permanent mitigation strategies, such as dredging of the lower West Fork, are completed.” 

When Does It Happen?

Seasonal lake lowering occurs twice annually – first in April/May and second in August/September.

How Much is It Lowered and for How Long?

In the spring, releases begin on April 1st. SJRA gradually reduces the level of Lake Conroe to 200’ mean feet above sea level (msl)—one foot below the normal Lake Conroe pool level of 201’ msl. Starting on June 1st, SJRA recaptures flows to restore normal lake elevation to 201’ msl. 

In the fall, releases begin on August 1st. SJRA gradually reduces the level of Lake Conroe with a goal of reaching 200’ msl by August 15th. After August 15th, gradual lowering continues with a goal of reaching (and maintaining) 199’ msl—two feet below normal pool—by August 31st. Starting October 1st, SJRA begins to capture flows to restore normal lake elevation to 201’ msl.

What If The Lake Is Already Down?

If the lake level has already dropped to the target elevation due to evaporation, no releases are made.

What if It Rains While the Lake is Already Lowered?

If a storm enters the forecast while seasonal releases are being made to lower the lake level, releases are stopped and the river is allowed to drain out until rainfall is out of the forecast.

Is There Science Behind This Policy?

Two engineering reports by Frees & Nichols from early 2018 show the benefits in terms of flood mitigation and the potential negative impacts to water supply. These reports as well as additional information about seasonal lowering can be found at: https://www.sjra.net/floodmanagement/.

Has it worked? Is there real value in terms of flood mitigation?

Yes. Looking at recent rainfall events, seasonal lowering resulted in both lower peak lake levels during storms and lower release rates from the dam.

For example, the spring 2019 seasonal lowering created an additional one foot of storage space to capture rainfall in early May 2019 when storms hit the Conroe and Lake Houston areas. Lake Conroe caught significant rainfall and runoff during the storms causing the lake to rise more than a foot. If Lake Conroe had entered this event at or near full, the peak release rate would have been higher thereby increasing the peak flow in the West Fork of the San Jacinto River. 

Is There a Benefit to Lake Conroe?

Seasonal lowering also reduces the peak Lake Conroe level during storms, which reduces negative impacts around the lake such as damage to docks and other personal property. During Harvey, several hundred homes around Lake Conroe flooded.

What is the cost of the release?

Lake Conroe was built as a water supply reservoir in the 1970s through a partnership between SJRA and the City of Houston. Two thirds of the water in Lake Conroe belongs to the City of Houston and one third to SJRA. The City of Houston can call for the release of its water at any time, and water supply reservoirs are built to fluctuate as demands or operational needs dictate. 

Releases such as those made for dam repairs and seasonal lowering are not charged to any particular customer, therefore it is not possible to assign a value to the water released. In addition, temporary, non-customer releases do not reduce long-term water supplies, therefore they are not considered lost revenue. 

To be considered as lost revenue, releases would have to happen at a time when the SJRA could not meet demand with water from Lake Conroe. But that has not happened.

And most important, if the water supply in Lake Conroe were ever threatened, say from drought, the SJRA would not be releasing water anyway. The lake level would already be far below the target level, making a release unnecessary.

Is This a Permanent Program?

No. Seasonal lowering is a temporary flood mitigation strategy that must be reconsidered each year by the City of Houston and the SJRA Board of Directors while more permanent mitigation strategies, such as dredging of the lower West Fork, are completed.

Lake Conroe Association Fighting Seasonal Lowering in Advance of SJRA Vote to Reconsider Policy

Efforts have started already to lobby against the seasonal lowering of Lake Conroe again next year. They seem to be organized and inspired by the Lake Conroe Association again. I understand that the lowering inconveniences some Lake Conroe residents, especially boaters who live in areas like Grand Harbor where the water depth is shallow to start with. However, the inconvenience pales in comparison to the damages suffered in the Lake Houston Area. The lowering helps provide a buffer against downstream flooding during the wettest months of the year. The SJRA will vote on whether to extend the lowering policy at its February board meeting.

A Campaign of Misinformation

The Lake Conroe Association and its proxies are deliberately spreading falsehoods to rile up people against the lowering. The same misinformation contained in the Lake Conroe Association presentation on their news page, is repeated in the website Stop Draining Lake Conroe (https://www.stopdraininglakeconroe.com) and the Grand Harbor YouTube video below.

For the Record…

StopDrainingLakeConroe.com states that:

Lake Houston dredging is complete and completely out of funding. Four fifths of the mouth bar on the West Fork remains in place. Harris County Flood Control has allocated $10 million to help dredge it. See item CI-61. The State of Texas allocated $30 million in SB500. Plans for that project should be announced next week according to State Representative Dan Huberty. The City of Houston has also filed for another FEMA Grant for additional dredging.

Lake Conroe homes are being damaged by the lake lowering. Really? How does that work? Is it the same as 250,000 CFS coming through your living room? That’s what happened to 81 townhomes in Forest Cove. See below.

Lake lowering is damaging bulk-heading around Lake Conroe. How does that work? Does evaporation destroy the bulk-heading? See the bulk-heading along the West Fork above.

There is no science to support the original action by the board, or for continuing this action plan. See these engineering reports by Frees & Nichols.

Downstream residents are trying to turn this into a permanent plan. Please tell me who. I’m not aware of any organized effort. The plan has always been to reconsider the lowering every year until flood mitigation measures such as dredging were complete.

SJRA is throwing away $5.33 million of water revenue. It would only be throwing away the revenue if it could sell the water. But there’s no unfilled demand due to water shortages in the lake. And the water replenishes itself as rain falls from the sky.

Water level of Lake Conroe is at 198. That’s an exaggeration to rile up the people in Grand Harbor, who normally only have four feet of water. The lake level is normally at 201′ and currently at 198.82′. That’s 198 and ten inches. So those Grand Harbor people have half their normal water, not one quarter. Current release rate is 0.

Lake Conroe only provided 15% of the water that flooded Kingwood. Lake Conroe only affects the West Fork, but the statistic includes the East Fork. During Harvey, West Fork flooding caused the vast majority of the damage. The Lake Conroe release comprised ONE-THIRD of the water coming down the West Fork through the highly populated Humble/Kingwood corridor where virtually 100% of the businesses are located. Lake Conroe released 80,000 CFS of the 240,00 CFS coming down the West Fork. So the 15% statistic is extremely misleading.

Video Makes Many of Same False Claims And Some More

The video includes many of the same false claims and a few new ones. Let me focus on the new ones.

The video states or implies that:

Describing the lowering as Seasonal rather than Temporary implies we are trying to make it Permanent. I’m not sure how you get from either of those words to “permanent.” This is a logical fallacy. It’s a falsehood designed to inspire fear.

Recent events show that Lake Conroe is being unfairly blamed for downstream flooding. Kingwood still flooded during Imelda “even though we didn’t release anything” during Imelda. Please! The vast majority of all Kingwood flooding during Imelda was street flooding or related to Woodridge Village. Some homes did flood on the East Fork, but I can’t believe any of those residents would blame it on a fictional release from Lake Conroe that wasn’t coming down the West Fork.

There was an “organized effort” in Kingwood to send an unspecified number of “letters” to the SJRA board thanking them for not releasing during Imelda. So what is it? Are we allegedly blaming you for flooding us during Imelda or thanking you for not flooding us? Show me the letters. I’m not aware of any such organized effort. See the comment above.

Kingwood is trying to increase the lowering to 3 feet and Kingwood is winning that fight by a large margin. I’m aware of no effort to increase the lowering and no fight that we’re winning by a large margin.

Wading birds that require shallow areas are being destroyed. Duh! They’re saying birds need shallow water, but they want to make the lake deeper. So if water depth had something to do with destroying birds, who would be destroying them?

Boating Vs. Flooding

Let’s face it. The big reason Lake Conroe residents don’t want to see their lake lowered is that it makes boating more difficult. No argument there.

But the big reason Lake Houston area residents want more dredging is not boating. It’s to reduce flood risk. The mouth bar forms a sediment dam behind the dam that reduces the conveyance of the river through the heavily populated Humble/Kingwood corridor. And until it’s dredged, we need the help of Lake Conroe residents. The lake lowering strategy gives us the only effective way to mitigate flooding for now.

After the Army Corps removed 500,000 cubic yards of sediment from the West Fork mouth bar, Imelda promptly redeposited much of it. Here’s what it looked like after Imelda.

Aerial Photos of Lake Houston Dam Dramatize Need for More Gates

Before Harvey hit, we knew tremendous rains were coming. But we could do little to prepare Lake Houston for the onslaught. The small gates you see in the photo below release a combined 10,000 cubic feet per second (CFS). That’s nothing compared to the 150,000 from the gates at the Lake Conroe Dam.

We Were Sunk

When Lake Conroe had to open its gates during Harvey, we were sunk. Literally. Had we had bigger, more modern gates on Lake Houston, we might have been able to lower the lake fast enough to avoid flooding thousands of homes.

11-Foot High Wall of Water Cascaded Over Spillway

Of course, Lake Houston also has a spillway. In fact, the spillway represents the primary way to shed water from the lake. The top of that spillway is at 42.38 feet.

The primary overflow mechanism on the Lake Houston Dam: a 3,160-foot long spillway.

But Harris County Flood Control District’s (HCFCD) final report on Hurricane Harvey stated that a record pool elevation of 53.1 ft was recorded at the Lake Houston Spillway.

Thus, at the peak of Harvey, a wall of water 11 feet high was flowing over that spillway.

HCFCD estimated that’s 5 times the average flow of Niagara Falls and that the flow rate would fill NRG Stadium in 3.5 minutes.

Ten More Gates Could Have Lowered Harvey Flood by 1.9 Feet

HCFCD commissioned a study by Frees & Nichols about what effect additional gates would have in the event of another Harvey. The study found that ten more gates could have lowered the level of the flood by up to 1.9 feet (about 23 inches). That would have saved thousands of homes from flooding in the Lake Houston Area.

Interestingly, the WAY more gates would prevent flooding was not through pre-release; Harvey would have refilled the lake in a matter of hours and the storm lasted days. Rather, additional gates would have widened the spillway area so more water could move over the dam every second. Think of it in these terms: twice the width, half the height. (That’s an over-simplified example of how the principle works; ten more gates would not actually double the width.)

Is Pre-Release Practical?

The Frees & Nichols study only considered one case – Harvey. For lesser floods, the gates could help make pre-release a viable strategy for the Lake Houston Area. At least in my opinion.

Here’s how.

  • More gate capacity could help offset the volume of water released from Lake Conroe, to reduce the risk of Conroe flooding Houston again.
  • More gate capacity could release more water in less time, thus reducing uncertainty when pre-releasing before a storm. That would allow officials to delay releasing water until they were sure they needed to. And that could save precious water in the event that a storm veers off in another direction at the last minute. We may know that a storm will cross the area. But it’s much harder to tell where the heaviest rainfall will occur. For instance, during Imelda, parts of the East Fork received more than 20 inches of rain while Lake Conroe received only two.

In the last year, the City prevented homes from flooding several times by pre-lowering the lake. But the small gate capacity meant that we had to start releasing water DAYS beforehand to make an appreciable difference in the lake level. That has to be nerve wracking for Public Works.

Where the Gate Project Stands

Earlier this year, the City of Houston secured a FEMA grant to design and construct more gates for the Lake Houston Dam. The two-phase grant covers design and construction. Each phase must be completed within 18 months, though extensions are possible. Currently, we are four months into the 18-month design phase. That means we should see more gates by mid-2022.

This morning, more than 22 months after Hurricane Harvey, the Barrington held a grand re-opening ceremony for its 18,000 square foot Manor House. When project manager Lauren Blackburn cut the red tape, residents got their first glimpse of a newly renovated and re-imagined community facility without equal in Kingwood, and perhaps without equal in the Houston area.

Time to Enjoy Life Again

Driving into the parking lot, I could sense the electricity in the air. A large crowd gathered in front of the Manor House. People wanted this.

Residents of one of the hardest hit subdivisions during Harvey were out to make a statement. Every home looked perfectly manicured and freshly painted. Every blade of grass looked neatly trimmed and postcard perfect. Golfers were enjoying the immaculate greens and fairways of the surrounding Kingwood Country Club. Even the bluebirds were singing.

Overwhelmingly Approved by Barrington Residents

Blackburn says her team of residents surveyed the community three times to determine what the new Manor House should offer. Residents volunteered ideas for everything from the types of activities to the art on the walls.

Even though renovations cost more than $750,000, a whopping seventy-two percent of the residents voted for them.

Reflecting Needs of Next Generation

The developer originally conceived the Barrington for people older than 55. However, the survey found that 30% of the families had children under 10. As a result, the design of the original building, built in 2002/2003 changed.

“The community is different and the Manor House reflects the composition and wishes of the community,” says Blackburn.

Cultivating a Sense of Community

“In fact, we designed it to cultivate a sense of community,” said Blackburn. “People can hold all kinds of private events here. Or just hang out with friends. Groups can hold private events. Book clubs. Watch parties. Bible study. Birthdays. Community meetings. Weddings. Receptions. No other community has something like this. It’s what makes us special.”

The Barrington offers stately homes on immaculate streets surrounded by the Kingwood Country Club and nature.

Defined by Dreams, Not Disaster

Yes, the people of the Barrington made a statement today. They said, “We will no longer be defined by disaster. We will be defined by our dreams.” And they’re making those dreams come alive.

SJRA Update, Upcoming Sunset Review and Enabling Legislation

Since Harvey, the Lake Houston Area has seen some huge changes for the better in the San Jacinto River Authority (SJRA). When the Governor visited Kingwood and took a helicopter tour of the San Jacinto River basin after Harvey, he directed the SJRA to establish a flood mitigation division. He also appointed two directors from the Lake Houston area to ensure downstream representation on the SJRA board.

Many Improvements Since March 2018

Since then, Kaaren Cambio and Mark Micheletti, the two new directors from the Lake Houston area, have led the charge to lower Lake Conroe seasonally. This ensures a greater buffer against floods.

The effort paid off this year when heavy back-to-back-to-back rains in early May would have forced a large release from Lake Conroe had it not already been lowered. That release, added to already swollen tributaries, would almost certainly have threatened low lying homes and businesses.

The SJRA will again lower Lake Conroe during the peak of Hurricane season. Starting August 1, it will take Lake Conroe down one foot. Beginning August 15, they will take it down another foot until October 1.

The SJRA is also working with Harris County Flood Control to install more upstream gages and turn the Harris County Flood Warning System into a Regional Flood Warning System with customizable alerts. The goals: create more awareness of upstream dangers to give people more time to evacuate and save valuables in the event of a flood. Said another way, avoid middle-of-the-night surprises like we had during Harvey.

Finally, the SJRA is leading a joint river basin study that hopefully will lay the groundwork for additional upstream detention, more flood gates for Lake Houston, and an ongoing maintenance dredging program. So, many good things are happening.

Cambio’s Term Expiring

However, Cambio’s term on the board expires this year. She wants to stay in the position and I hope she does. Cambio has worked tirelessly to mitigate flooding on so many levels. Her position as a key staffer for Congressman Dan Crenshaw also makes her uniquely qualified to help coordinate efforts from Federal, State and local agencies. She deserves reappointment.

A reader asked whether there’s an opportunity to increase downstream representation on the SJRA board with more representatives like Cambio and Micheletti.

The answer is, “In the short term, no.” Cambio’s seat on the board is the only one up for renewal this year.

SJRA Sunset Review Coming Up

However, in two years, the entire SJRA will come under close scrutiny as part of a sunset review. A sunset review is an evaluation of the need for the continued existence of a program or an agency. It assesses their effectiveness and performance, and recommends either retaining, modifying, or terminating them.

The SJRA comes up for sunset review in the 2020-2021 cycle. Section 325.025 of the Texas Sunset Act mandates a review by September 1, 2021, and every twelfth year thereafter. See page 34 of the this PDF.

No one expects the SJRA to be terminated. But many other river authorities that have gone through the sunset review process, have had a complete overhaul, said one source who spoke on condition of anonymity.

The Sunset Commission has been brutal at times. For instance, between 2016 and 2017, the Commission reviewed four river authorities and noted:

  • “Sulpher River Basin Authority Board has not built the trust needed to effectively carry out its mission.”
  • “Central Colorado River Authority no longer serves a necessary public purpose.”
  • “Upper Colorado River Authority has not set priorities to ensure its operations meet changing local watershed needs.”
  • “Palo Duro River Authority of Texas lacks flexibility to adapt to changed local circumstances.”

Their report makes fascinating reading. One thing that became clear in scanning it is that, like most good performance reviews, the Commission judges performance against objectives. In the case of these Authorities, enabling legislation spells out the objectives.

Enabling Legislation Established SJRA Goals

That prompted me to review the enabling legislation for the SJRA. The sections discussing goals begin on page 2 of this PDF. I have summarized them below.

The state created the SJRA (originally called the San Jacinto River Conservation and Reclamation District) to “conserve, control, and utilize to beneficial service the storm and flood waters of the rivers and streams of the State.” Section 2 of the enabling legislation mentions floodwaters three times.

Section 3 starting on page 3 of the same PDF lays out additional goals. For instance, to:

  • Prevent the devastation of land from recurrent overflows.
  • Protect life and property.
  • Regulate the waters of the San Jacinto River and its tributaries.
  • Build dams and distribution networks that provide waters for cities, towns, irrigation, agriculture, commercial, industrial, mining and other beneficial uses.
  • Develop drainage systems that enable profitable agricultural production.
  • Conserve “soils against destructive erosion and thereby preventing the increased flood menace incident thereto.”
  • Forest and reforest the watershed to aid in the prevention of soil erosion and floods.
  • Encourage, aid, and protect navigation and harbor improvements.
  • Acquire land for parks and recreation, and to build park and recreational facilities thereon.
  • Dispose of sewage and industrial waste.
  • Construct, improve, maintain, operate and repair water and sewage plants and distribution networks.

How Would You Rate Performance against These Goals?

It seems to me that the SJRA does a great job at its basic mission. And they’re improving at flood mitigation. However, for decades, the SJRA ignored other crucial parts of its job description, including flood and erosion prevention; reforestation; parks and recreation; and navigation protection. In fairness, the Legislature never funded those mandates. The SJRA’s only income comes from the sale of water which it impounds.

Still, you would think somebody could pick up a phone and call the TCEQ for help with some of these things. For instance, sand mines along the banks of the river dump effluent and sediment directly into the drinking water supply for millions of people. It will be interesting to see what kind of changes the Texas Sunset Commission recommends when the SJRA comes up for review.

Army Corps Moving Forward with Partial Mouth Bar Dredging to Reduce Flood Risk

The Army Corps announced Monday that it will begin dredging approximately 500,000 cubic yards of the giant sand bar at the mouth of the San Jacinto West Fork. It has been linked to flooding in the Humble-Kingwood-Atascocita area. However, previous estimates put the total volume at close to 2 million cubic yards, with the volume due to Harvey at 1.4 million cubic yards.

GALVESTON, Texas (June 10, 2019) – The U.S. Army Corps of Engineers Galveston District staff executed a modification to the West Fork San Jacinto River Emergency Debris Removal contract June 7, 2019, to dredge an additional 497,400 cubic yards of material that was deposited in the mouth of the San Jacinto River from Hurricane Harvey.

“This contract modification will ensure a decrease in threats to critical infrastructure and lower the risk to potential loss of life,” said Charles Wheeler, USACE Galveston District project manager. “This is an ongoing contract that is part of a Federal Emergency Management Agency mission assignment.”

According to USACE Galveston District officials, the dredged material will be placed at the existing location referred to as Placement Area 2, which is located approximately 10 miles upriver. The additional dredging is scheduled to be completed by the end of 2019, with the demobilization of the equipment completed by early 2020.


No Mention of Other Partners

The press release does not mention the City of Houston, Harris County, the State of Texas, or Congressman Dan Crenshaw’s office. Most had been negotiating with FEMA and the Corps as late as last Friday.

On two previous occasions, the City announced agreements in principle with FEMA and the Corps. However, the two sides still had many details to work out relating to volume, storage, permitting and cost. The City and FEMA have tried to reach agreement on the volume of sediment deposited by Harvey since last October – eight months.

In February, the City, hired Tetra Tech to collect and analyze core samples from the mouth bar. In late April, Tetra Tech estimated, through a protocol recommended by FEMA, that Harvey deposited 1.4 million cubic yards of sediment at the mouth of the river.

Two Sides Far Apart in Negotiating Volume

The Corps’ announcement reveals just how far apart the two sides were in their volume estimates – about 900,000 cubic yards. That difference means much of the mouth bar area will remain undredged – at least for now.

With approval to remove only about 500,000 cubic yards, the dredgers will have to cut a channel around the mouth bar, most likely on the deeper Atascocita side. Ironically, that would mean leaving behind sand deposited above water by Harvey – a decision that could confuse the public.

Great Lakes Dredge Moving into Position

Great Lakes finished dredging its half of Phase One on April 12, exactly two months ago. The company has waited patiently ever since for the decision that finally came last Friday.

Today, the Great Lakes dredge has anchored near Kings Harbor. Judging by the weeds and logs in the pictures below, it appears that they will have to dredge their way TO the mouth bar. That could use up some of the precious approved volume. It could also take several weeks to position and calibrate all the equipment necessary to pump sediment 10 miles upriver.

While taking this shot this morning, I noticed that workers were finally starting to renovate Sharkey’s, one of the most popular restaurants in Kings Harbor before Harvey.

What Comes Next?

Pumping sediment from the mouth bar to PA-2 will require the horsepower of the larger Great Lakes dredge. It will also require several extra booster pumps and miles of additional 24 inch pipeline. The Great Lakes dredge has now moved downstream and is anchored east of the West Lake Houston Parkway bridge near Kings Harbor.

Last week, dredge pipe re-appeared under the 59 bridge after being gone for two months. That fueled rumors that the two sides had finally worked out some kind of deal. At this hour, the mystery is where does the Corps’ decision leave all the other parties in this process? More important, where does it leave the remainder of the mouth bar?

Other Money Available

The state approved an additional $30 million for dredging the mouth bar last week. The county also allocated $10 million in the flood bond approved by voters last year (see item CI-61). That $40 million along with another $18 million committed by the City of Houston would add up to $58 million. In addition to the unspecified sum FEMA is fronting now, that might be enough to remove the entire mouth bar. That could happen one of two ways:

  • The City, Corps, FEMA and TDEM would have to increase the approved volume after the next phase starts or…
  • The City, County and TDEM would have to remove the rest without FEMA and the Corps.

However, money is just part of the problem. The second option might require permitting another placement area. Permitting could delay the project. But permitting a closer placement area might also save money. It gets complicated.

PA 1 is filling up rapidly as the pictures below show. And PA-2 is so far upriver from the mouth bar that would cost extra millions of dollars to use.

Several months ago, this was all water. The owner of the pit is now selling sand to an asphalt company and the pit is still filling rapidly.

Easy Way to Save Money

Shortening the distance between the mouth bar and the placement area could reduce the amount of diesel and manpower needed to run the booster bumps. Each booster uses more than one thousand gallons of diesel per day. So costs add up rapidly. That’s why the Corps is still considering other placement areas.

Berry Madden owns several thousand acres south of River Grove Park between the river and FM1960. According to Madden, using his property could save the government $5.5 million in pumping costs. And that’s just on the first 500,000 cubic yards. If 2 million cubic yards is an accurate estimate for the total mouth bar, using Madden’s property could save $22 million. That’s even more than the remobilization costs we were trying to save.

I hope we don’t stretch this out too much longer or make it any more difficult. My truck needs some repairs and I’m afraid, as a taxpayer, that I may not be able to afford them!

One Less Thing to Worry About in Latest Storm: How Seasonal Lowering of Lake Conroe Helped

Storms during the last two days were traumatic for virtually everyone in the Kingwood area. Tragically, one person lost her life when her car hit a downed tree.

  • Others lost vehicles, trees, and sleep.
  • Torrential rains for a brief period – at the rate of 4-5 inches in an hour – flooded streets and vehicles.
  • They also brought water near or into homes.
  • Parents picking children up from school waited in rising waters as their students sheltered in place.
  • A small tornado may have briefly touched down near Town Center.
  • Kingwood Drive was shut down for hours during the Friday afternoon rush hour.
  • People traumatized by Harvey were re-traumatized.
  • People without power waited and wondered for hours about what was going on around them.

Lake Conroe: One Less Worry This Time

Despite all that, we did NOT have to worry about one thing: Lake Conroe opening its flood gates again during this storm. The seasonal lowering policy established last year worked.

The SJRA board voted to lower the lake’s level one foot to 200 mean feet above sea level (MSL) from April 1 to May 31.

That action may have saved the Lake Houston area from additional flooding in the last round of storms.

Releasing Water Continuously At Low Rate Created Extra Capacity

Lake Conroe had released water continuously since April 1 at a slow, controlled rate of 350 to 550 cubic feet per second. However, because of spring rains, Lake Conroe had only dropped about a half foot from 201 to 200.66 feet MSL. Had the releases not happened, the lake would have been an estimated 1-1.5 feet higher, according to Mark Micheletti, an SJRA board member from Kingwood. That means the lake level would have been approaching 202 feet, the level at which the SJRA automatically begins releasing water, when the storm hit. That would have forced the SJRA to release water at a higher rate that could have overloaded the downstream watershed.

Buffer Against Downstream Flooding Worked

In other words, the policy worked. The seasonal lowering provided a buffer against downstream flooding. NOAA shows a double crest on the San Jacinto West Fork at US59 during the last two days that coincided with two waves of storms. At peak flow, the river came within about two feet of going out of its banks.

An additional foot of water released from Lake Conroe would have added two feet to Lake Houston and created flooding.

About a mile downstream at River Grove Park, the water was up, but still within its banks.

Despite torrential rains last night and early this morning, the West Fork remained in its banks. The river was up, but no homes flooded from the river.

Success: No Rivers or Streams Out of Banks

At this hour, neither NOAA, the SJRA, nor Harris County Flood Control, predicts any flooding from yesterday’s storms. In fact, all streams and bayous seem to be receding at this time. That’s one less thing to worry about as we clean up from the latest storm. The SJRA’s seasonal lowering DID help.

Remember, Lake Conroe is almost twice as big as Lake Houston (33 sq. mi. vs 18.5 sq. mi.). So one foot released there translates into almost two feet here. And two feet would likely have forced the San Jacinto out of its banks for the fifth time in a year.

Kudos to the SJRA board, the City of Houston, and the TCEQ for enabling this policy. That, in conjunction with the City’s pre-release policy for Lake Houston, have made a difference.
