Looking Through the Wrong End of the Drainpipe: The Politics of Misdirection

Seventh in a series of eight articles on flood-mitigation funding in Harris County.

For the last two years, I’ve heard the same tirades in Commissioners’ Court – that rich neighborhood’s get all the flood-mitigation money while the poor neighborhoods get none. According to Commissioners Ellis and Garcia, that’s because higher home values in rich neighborhoods generate higher Benefit/Cost Ratios and therefore get more FEMA grants. Problem is, FEMA looks at many other factors. And HUD grants favor low-income neighborhoods. But you never hear Ellis or Garcia talk about those.

In reality, most flood mitigation-money in Harris County goes to watersheds with high percentages of low-income residents. (See links to previous posts below.)

By focusing on a narrow part of the flood-mitigation funding process as opposed to outcomes, Ellis and Garcia have been looking though the wrong end of the telescope. Why? To focus attention on the wrong end of the drainpipe! 

In the most flooded parts of Halls and Greens watersheds, street after street has clogged ditch drains. Responsibility for cleaning those drains falls onto, you guessed it, Ellis and Garcia, along with their counterpart at the City of Houston, Mayor Sylvester Turner.

Simple FOIA Request Disproves Narrative

The Ellis/Garcia narrative just didn’t sound right to me. So I submitted a Freedom-of-Information-Act (FOIA) request to the Harris County Flood Control District in March for historical funding data. I wanted to see if the allegations were true. They’re not.

Analysis shows that the Ellis/Garcia narrative is 180-degrees from the truth. By almost any statistical measure, flood-mitigation spending favors the poorer watersheds in Harris County. That’s where most of the damage is. 

Surely Commissioners Ellis and Garcia can’t be oblivious to more than a billion dollars of construction benefitting their own precincts. 

And had they bothered to look, they would have found Kingwood, their favorite whipping boy, has never received one Harris County Flood Control District Capital Improvement Project.

Verbal Sleight of Hand Deflects Attention from Who’s Responsible

So, what’s going on here? Why the constant barrage of racial accusations and divisive rhetoric? 

In my opinion, the deception, omissions and distortions of fact are about misdirection.

They seem designed to deflect attention from those responsible for a crucial part of the problem: street drainage.

And if you don’t fix that, you will never solve flooding no matter how much money you throw at channel widening, detention ponds and green solutions.

A process engineer in the oil and gas industry once told me, “There’s always a bottleneck in every system somewhere.” And one of the biggest issues in neighborhoods that flood repetitively is street drainage. Water can’t get out of the neighborhoods to the bayous.  

Poor Ditch Maintenance Contributes to Street Flooding

By alleging racism in the HCFCD funding, Commissioners Ellis and Garcia are deflecting attention from a serious issue; many of the neighborhoods in their jurisdictions have awful internal drainage (streets and storm sewers) that contribute to frequent street flooding. Street flooding happens when high rainfall rates exceed the capacity of storm drains and ditches to carry the water away. The reduced capacity of the ditches below makes the streets flood on smaller rains.

Ignacio Vasquez has lived in Kashmere Gardens for 45 years. He says he has called 311 about blocked drains like this one on Engleford St. “thousands of times”, but they never get fixed. City of Houston’s maintenance responsibility.

Vasquez says that after a heavy rain, this drain backs water up throughout his neighborhood and contributes to flooding. He says it can take up to 3-4 days for water to drain away. Completely unprompted, he then said that Kingwood was getting all the help from the City. I told him that I lived in Kingwood and that our drains were just as bad as his. See below.

But I digress. Here are some more street drainage photos taken on 6/26/21 in Halls and Greens Bayou Watersheds as well as Kashmere Gardens on the southeast corner of US59 and Loop 610.

Wherever I drove for five hours, residents repeatedly told me that because of poor maintenance, water has a hard time getting out of neighborhoods. It must either sink in or evaporate. See below.

To be fair, not all the ditches were this bad. But I saw thousands like these on hundreds of streets while driving around for five hours. Sometimes sediment almost completely covered drains. I often had hard times spotting the pipes.

The saddest sight I saw all day was this home on Etheline Street between Homestead and US59.

With drainage this bad, water may evaporate or infiltrate faster than it flows out of neighborhoods!

Who is Responsible for Streets and Storm Sewers?

Who is responsible for clearing blockages like these? Not the Harris County Flood Control District.

Inside the City of Houston, it is the Houston Public Works Department and a mayor who has been sued for diverting drainage fees.

Who is responsible for the unincorporated areas of Harris County? The Precincts. And the worst drainage happens in Precincts One and Two with Commissioners Ellis and Garcia.

  • Why does Kashmere Gardens (in the City) have open ditch drainage that hasn’t been maintained in years?  
  • How do areas in East Aldine still have barely functional roadside ditches and residents who do not have municipal water and sewer service?  

Commissioners Ellis and Garcia have the power and the money to address these issues. Yet they have chosen not to. Why have they not helped the very people they claim are left behind?  

Show Us the Data

It is important to note the questions NOT being asked in this so-called “equity” debate. 

  • How much has the City of Houston invested in these flood-damaged areas to remediate drainage?  
  • How much have Precincts 1 and 2 invested?  
  • What drainage projects have they completed since 2000?
  • What is the capital improvement plan for each precinct, and how much of that includes drainage improvements?
  • What is the equity prioritization framework for precinct spending?
  • How much unspent money does each precinct have for infrastructure?

The answers may point right back at the people making racial accusations.

The City and Commissioners Ellis and Garcia need to provide answers. Let’s see the data. How much have the City and the Precincts spent in these areas? If these areas are underserved, Commissioners Ellis and Garcia, and Mayor Turner are responsible.

They have claimed transparency is important to them. The time to prove that is now. 

Blaming the problems on racial discrimination is an easy sell in minority neighborhoods. But it’s misdirection and it keeps the spotlight off Commissioners.

Hounding talented executives like Russ Poppe, the soon to be ex-head of the flood control district, out of their jobs won’t fix the issue either. That’s also misdirection.

And it diverts focus from finding solutions to the real problems that contribute to flooding. For that, many people need look no further than the end of their driveways.

We all need to step back and look at flooding from end to end. Then maybe we’ll make life easier for the most vulnerable people among us.

Watersheds with Low Voter Turnout Get Most Flood-Mitigation Funding

Sixth in a series of eight articles on flood-mitigation funding in Harris County

In August of 2018, Harris County voters approved a historic flood bond of $2.5 billion. Afterwards, KTRK ABC13 created an interactive precinct-by-precinct voter turnout map for the referendum.  Now, with spending data for flood mitigation projects in hand, we can see that, in general, but not in every case:

  • Watersheds with the highest turnout are getting the least money
  • Those with the lowest turnout are getting the most money.

Ironically, the worst-damaged areas generally had the lowest turnout.

Four Maps Tell Story

Let’s start by looking at four maps. They show: 

  • Location of six low-income watersheds used in a quartile analysis
  • Location of six six high-income watersheds used in the same analysis
  • Voter turnout for the 2018 Harris County flood-bond referendum
  • Damage from Harvey

Ironically, low-income watersheds had the lowest turnout for the 2018 flood-bond referendum and they’re getting the vast majority of flood mitigation funding.

Previous articles in this series have shown that, out of 23 watersheds in Harris County, six low-income watersheds:

Location of Lowest Income Watersheds

The low-income watersheds are all located primarily inside the Beltway.

Most of Greens Bayou is inside Beltway 8, though a portion of it wanders just outside.

Now let’s look at the location of the six high-income watersheds.

High-income watersheds are all outside the beltway.

Who Approved that $2.5 Billion Flood Bond?

Now look at the voter turnout map below from the 2018 flood bond referendum. 

  • Light areas had the lowest voter turnout. 
  • Dark areas had the highest voter turnout. 

Note the area inside the yellow outline. It contains all the watersheds that Commissioners Ellis and Garcia complain about the most as having the least funding: Greens, Halls, Hunting, White Oak and Sims.

Some precincts in those watersheds had 0 voters. That’s right. No one showed up at the polls. At all. Many precincts had less than 1% turnout. Those light tan-colored areas generally had 1-5%. 

The darkest areas, such as those around Kingwood, had turnout in the 20 to 30% range – generally 5-20 times higher than in the neighborhoods where most of the money is going. 

In fact, Kingwood precincts had five of the top eight turnout percentages in the county. But Kingwood has NEVER received even ONE Harris County FLOOD CONTROL DISTRICT capital improvement project.

Damage Concentrations

Compare damage in Harvey (below) with the area outlined in yellow in the map above.

When you consider these four maps together with the historical funding data discussed in previous posts (see links below), they show that most of the money is already going where most of the damage was. 

But large pockets of damage exist elsewhere that get comparatively little to no funding.

For instance, in the map above, note the curving arc of damage along Cypress Creek in the northern part of the county which extends into the Humble/Kingwood area.

People in those damaged areas turned out in high percentages for the flood bond. But they are seeing the vast majority of flood-mitigation projects being built in neighborhoods that didn’t even bother to vote in many cases. That doesn’t bode well for future bonds referendums.

Misleading Statements Undermine Trust in Government and Future

Some political leaders are telling poor people that flood-mitigation projects are all going to rich neighborhoods and the Houston Chronicle blindly repeats what they say without checking the real numbers. Or even bothering to mention projects already completed.

But as I’ve shown in previous articles (see links below), depending on how you measure it, up to three quarters of the money is actually flowing to poor neighborhoods.

Certain Harris County commissioners have fought to prioritize funding for minority and low-income neighborhoods. And in the next Commissioners Court meeting on Tuesday 6/29/21, they’re pushing to expand that prioritization framework to include future projects and funds. See Item 191 on the agenda.

Yet poor people believe all the money is going to rich watersheds – because that’s what their leaders tell them. And rich people see the lion’s share of the money going in the opposite direction.

Everyone believes someone else is getting the funding. So who would vote for another flood bond at this point? No one.

How are you going to convince people that taxed themselves $2.5 billion – and think they aren’t receiving any benefit from it – to vote for the next bond?

We need to restore trust in government by giving people accurate information, not misleading them with racial rhetoric for political gain. More on that tomorrow.

Low-Income Watersheds Get Three Times More Flood-Mitigation Funding Per Square Mile

Fourth in a series of eight on flood-mitigation funding in Harris County

Since 2019, Commissioners Ellis and Garcia have harped on the need for more “equity” in flood-mitigation funding. They and some residents in their precincts allege that all the money is going to high-income watersheds while minority, low-income watersheds get “none.” Ellis repeatedly complains that Harris County Flood Control District gives those minority neighborhoods “back-of-the-bus” treatment. Garcia says he feels like he was “hit with a baseball bat.”

Unfounded Allegations of Racism in Construction Funding

In March, I became so alarmed at the allegations of racism, that I submitted a Freedom of Information Act Request to see if they were true. They aren’t. Funding data for new construction projects dating back to 2000 shows that:

Those first three articles in this series should suffice to disprove discrimination against minority, low-income watersheds. But more statistics just keep jumping out of the data. 

So, today let’s compare watersheds with percentages of low-to-moderate-income (LMI) residents above and below 50%:

  • The low-income group has 7 watersheds, comprising 584 square miles.
  • The high-income group has 14 watersheds, comprising 1123 square miles. 

The two groups vary radically in number and geographic size. So, to provide a valid comparison, we must evaluate them first on a per-square-mile basis. This pie chart shows how the smaller, low-income group gets triple the dollars per square mile.

On a per-square-mile basis, low-income watersheds (blue) have received 3X more capital improvement funding than high-income.

Watersheds Above/Below 50% LMI 

Here are the percentages of LMI residents in each group.

Shows proportion of low-to-moderate-income residents in each watershed. Those with higher percentages actually have lower average income. So to avoid confusion, I refer to these groups as low- and high-income.

Lower Income Watersheds Get 3X More Construction Funding Per Square Mile

On a per-square mile basis, the low-income group averaged $2.5 million. The high-income group averaged only $0.8 million. See Table 2 below.

Includes dollars for funding of construction projects (not maintenance) since 2000. Remember: ABOVE 50% LMI actually means BELOW AVERGE INCOME.

When looking at funding per square mile, the low-income group averaged 3X more.

 

Smaller, Low-Income Group Also Receives About a Third More in Total Dollars

Comparing the total dollars (not $/square mile) received between the two groups is also illuminating. 

In total dollars, the low-income group of 7 received $400 million dollars more than the high-income group of 14 since 2000. That skewed the averages back toward 3X again. See Table 3.

The small low-income group received a third more funding in total dollars since 2000. And the average per watershed was 2.6X higher than the high-income group.

But More Damage in Low-Income Group

As we have seen elsewhere in this series, dollars flow to damage. Low-income watersheds had twice the total damage despite being half the size and number

In four major storms since 2000 (Allison, Tax Day, Memorial Day and Harvey), the seven low-income neighborhoods had 146,832 structures damaged, compared to 70,719 for the higher income group of 14. However, on a per square mile basis, low-income group had four times as much (251 vs. 63). 

Structures damaged in four major storms in the groups of watersheds listed above in Table 1. Note that these averages can conceal wide variations within groups. Cypress Creek, for instance, had 20 times more damage than several other watersheds in its group.

So, the hardest hit watersheds already receive the most funding. By a wide margin. And they have since at least 2000.

Together with other data in previous posts, this proves HCFCD does not discriminate against minority low-income neighborhoods in flood-mitigation spending.

Dollars flow to damage – not affluent communities. 

Low-income watersheds still have ongoing HCFCD construction for flood mitigation projects. But they also have other large problems that contribute to flooding for which HCFCD is not responsible. I’m talking about issues related to street flooding such as: 

  • Aging storm sewers with low capacity built to old development standards
  • Roadside drainage swales filled with sediment
  • Homes not elevated enough above street level

Other people and groups are responsible for fixing such problems – including the City of Houston and Harris County Precinct Commissioners themselves. 

In conclusion, elected representatives have misled Harris County residents. This raises the question, “Why?” I will discuss my opinion in a future post.

Six Low-Income Watersheds Receive More Funding than 15 Higher Income Watersheds Combined

Third of an eight-part series on flood-mitigation funding in Harris County

Some people and their representatives in low-to-moderate-income (LMI) watersheds have complained that they get “no” flood-mitigation funding and that the money is all going to richer watersheds. Allegedly, that’s because home values are higher there and thus favor higher benefit/cost ratios (a sort of systemic racial discrimination). But is that true? Do higher home values in a neighborhood really translate into “projects funded”? No. The allegation ignores many other factors that enter into funding, such as damage and population density. Density is two to three times higher in low-income neighborhoods and that influences damage totals. When you look at funding outcomes as opposed to a sliver of the mitigation process, low-income neighborhoods get far more money. Here’s how it breaks down.

Where Money is Really Going

Recently, I obtained flood-mitigation funding data for every watershed in Harris County via a Freedom of Information Act (FOIA) request. It sheds new light on this subject.

In addition to the quartile comparisons I did in earlier posts, I also compared the top quartile (six watersheds) to the rest with one exception in each group noted in previous posts and the footnote below.* The data showed that six watersheds with the highest percentages of LMI residents (meaning low income) have received 56.8% of HCFCD spending out of the 21 remaining watersheds since 2000.

A second pattern also clearly emerged from the data. Long before “equity” guidelines were put in place, HCFCD spending closely tracked flood damage. It still does. And the most damage occurred in lower-income watersheds.

In this post, I will examine both trends by looking at six watersheds with the highest percentages of LMI residents. They include Brays, Greens, Sims, Halls, Hunting and White Oak Bayous. 

As a group, they:

  • Comprise 30.9% of the square miles in the county
  • Received 56.8% of total spending – $1.52 billion of the $2.6 billion spent by HCFCD since 2000.

That’s more than 15 higher income watersheds combined.

Dollars Flow to Damage

But if you stopped there, you could conclude that these six watersheds were getting more than 2-3X their fair share of funding. However, also consider that they had 144,754 out of the 222,739 structures damaged in Harris County during Allison, Tax Day, Memorial Day and Harvey floods.

One thing is certain: these six watersheds have not been at the “back of the bus.” They received more than $1.5 billion out of $2.6 billion invested by HCFCD since 2000. 

The data DISPROVES discrimination on an income or racial basis. Money is not going disproportionately to rich neighborhoods. Far from it. It’s going disproportionately to poor and minority neighborhoods. However, that is also where the most flood damage occurred. Let’s take a closer look at each of the six low-income watersheds.

Brays Bayou:
  • Received 19% of total spending since 2000, but represents just 6% of the county’s area.
  • Received more than half a billion dollars since 2000, the most of any watershed, and about one-fifth of all flood-mitigation spending in 23 watersheds in 21 years.
  • Received the second most funding since Harvey ($130,685,844.43).
  • Got 4 times the average and 7 times the median of flood-mitigation funding for all watersheds.

It certainly seems like an outsized injection of flood-mitigation funds. But the improvements also protect some major infrastructure and employment centers including the Texas Medical Center. See this photo essay taken from the air.

Also consider that Brays had the most damage in four major storms (Allison, Tax Day, Memorial Day, Harvey) – 32,194 structures flooded. 

Brays has the fifth highest percentage of low-to-moderate income residents (58%).

HCFCD construction is on-going in this watershed.

Greens Bayou:

Commissioners Ellis and Garcia often cite Greens Bayou as a “back-of-the-bus” watershed. They also say, that if the County doesn’t fix it, “we’ll have blood on our hands.” 

Greens received the 3rd most dollars since 2000 and the 2nd most since Harvey. That’s 11% and 14% of all HCFCD spending respectively during those two time periods. Only in Harris County politics can you call second place out of 23 “back of the bus.” 

But Greens also had the second most damage in four major storms (28,815 structures). 

Greens Bayou has the sixth highest percentage of LMI residents in the county (57%).

HCFCD construction is also on-going in this watershed.

Halls Bayou:

Mr. Ellis and Mr. Garcia also consider Halls Bayou funding to be “back of the bus.” It comprises only about 2.4% of the county but received almost 5% of total spending since 2000. It also received:

  • The fourth most funding per capita ($841.77)
  • The third most funding per square mile ($3,031,912)
  • The eighth most funding since 2000 ($128 million).

Residents still believe they received “nothing,” but I photographed eight large detention ponds recently completed or under construction. Four are right next to US 59.

Halls has the highest percentage of LMI residents (71%) in Harris County.

Sims Bayou:

Sims Bayou runs through the southern part of the county. It:

  • Ranks as the 8th largest watershed.
  • Received the 6th most funding since 2000 ($165,013,368)
  • Has the 7th largest population (310,537)
  • Has the 5th highest population density (3755 per sq. mi.)
  • Had the 6th most damage (18,122 structures)

Sounds proportional and it is. 

However, these calculations do not include $254 million, which the U.S. Army Corps of Engineers spent on Sims between 1990 and 2015 (by itself) for a major flood-reduction project. The Corps’ contribution to Sims Bayou alone was almost 10% of all HCFCD spending since 2000 ($2.68 billion).

If you add the Federal contribution to HCFCD’s funding, Sims would have ranked second on the list of flood-mitigation dollars received since 2000. Only Brays received more.

Sims has the third highest percentage of LMI residents (65%).

Hunting Bayou

Hunting Bayou is one of the county’s smaller watersheds. It comprises 31 square miles or 1.7% of the county’s land mass. That ranks it as the 19th largest bayou out of 23. And it has the 14th largest population (78,213). Yet, since 2000, it has:

  • Had the seventh most damage (15,728 structures)
  • Received the third most dollars per capita since 2000 ($952.18)
  • Received the fourth most dollars per square mile ($2,402,908)

Hunting Bayou has the second highest percentage of LMI residents (69%).

HCFCD construction is on-going in this watershed.

White Oak

White Oak Bayou is the sixth largest watershed in Harris County. Yet it received 13% of the flood-mitigation funding since 2000 – $349 million, the second highest total of any watershed. It also ranked second in dollars received per square mile – $3.14 million.

But also consider that it had the third highest number of damaged structures – 24,989 in Allison, Tax Day, Memorial Day and Harvey floods combined.

51% of the residents in White Oak qualify as low-to-moderate income. 

HCFCD construction is on-going in this watershed.

Damage-to-Dollar Rankings

“Damaged structures” and funding received had the highest correlation of any relationship I tested. For math majors, the coefficient was .86. That’s high. A perfect correlation would be 1.0. For the less technically inclined, see the table below.

Contrary to the “rich-watersheds-get-all-the-money” narrative, flood-mitigation funding, data shows that HCFCD is putting the most money in the hardest hit watersheds.Dollars flow to damage.

Many projects in these lower income watersheds are still under construction or preparing for it. And major storms have not yet tested many recently constructed improvements. Regardless, their residents are safer than they otherwise would be. And they can take some comfort in knowing that the system is working for them, not against them.

GLO Letters to HUD, Green, Garcia Tell Another Side of Mitigation Funding Story

Two letters from Texas General Land Office (GLO) – one to the US Department of Housing and Urban Development (HUD) and the other to US Representatives Al Green and Sylvia Garcia – explain the GLO’s awards in a recent competition for $1.1 billion in Harvey mitigation funding.

GLO Commissioner George P. Bush sent the first letter to HUD on May 27, shortly after the GLO “snubbed” (according to Mayor Sylvester Turner) Houston and Harris County. Outraged politicians at City Hall and the County Courthouse organized a protest campaign targeted at the HUD and the GLO. These two letters lay out a slightly different mitigation funding story than the one peddled to Houston media outlets by the City and County. Most media coverage trumpeted how Houston and Harris County got “zero” out of competition because of political warfare between Republicans in Austin and Democrats here.

The facts in these two letters got very little play in Houston media.

Bush Letter to HUD Requests $750 Million Direct Allocation for Harris County

Bush’s letter explains to HUD how the GLO organized and scored grant applications in the competition. The letter also explains how:

  • GLO received more than $6.5 billion in grant requests for $1.1 billion during floods in 2015, 2016, and 2017.
  • Money was awarded based on a numeric scoring system approved by HUD
  • Harris County was one of dozens of counties affected by the three storms
  • Harris County and Harris County communities were awarded $90.4 million and $26.7 million for a total of $117,213,863.96 in the first round of mitigation competition.
  • He (Bush) is submitting a “new action plan amendment” to that will direct $750 million to Harris County.
  • GLO recognizes the great need for mitigation funding in Harris County.
  • GLO supports a direct allocation to Harris County (non-competitive)
  • He (Bush) requests speedy approval of the action plan amendment/direct allocation.

Hmmmmm. $117 million is a little more than zero. However, the point to remember here is that Harris County Flood Control got zero. The $117 went to cities within Harris County to improve resilience.

Havens’ Letter Cites HUD Restrictions, Slow Rate of Drawdown for Previous Programs

Deputy GLO Land Commissioner Mark Havens penned the second letter to Green and Garcia on June 10, 2021. It begins by making some of the same points about $6.5 billion in applications, HUD-approved rules, etc. But then, in regard to the rules he adds something new in the debate.

HUD did not allow damage from Hurricane Harvey to be used as a metric for allocating CDBG-MIT (Community Development Block Grant Mitigation) funding!

Deputy Commissioner Havens also points out that:

  • The previous HUD secretary was adamant that a direct allocation didn’t go to Houston and Harris County, and that all counties should be eligible for funds.
  • If you add the $117 million mentioned above to the $750 million direct allocation requested by Bush, Harris County would actually get $867 million which the County could then share with the City of Houston as it saw fit.
  • Harris County also set aside $120 million in infrastructure funding out of the original $2.5 billion allocated to the County and City in the first round of Hurricane Harvey funding.
  • The City also received a direct allocation of $61,884,000 in mitigation funding out of the original $2.5 billion.
  • Out of the $2.5 billion, only $91,225,206 – or 3.6% of the total has been drawn down to date.
  • If the City and County don’t dramatically speed up the distribution of these funds, the funds will be returned to HUD.
  • HUD not yet responded to the request for the $750 million direct allocation.

Flash Flood Watch, Flood Warning Extended

Flood Watch through 7 P.M. For Most of Region

The National Weather Service (NWS) has issued a flash flood watch for most of the Houston region. The watch will last through 7 P.M. this evening.

Flood Warning Through Saturday Morning For Smaller Areas

In addition, NWS has issued a flood warning for counties to the west and east of Houston. See map below.

Precautions:

Persons with interests along these streams should keep alert to rising water and take all precautions to protect their property. Do not drive or walk into flooded areas the depth and water velocity could be too great for you to cross safely. Avoid any water covered roads and find an alternate route. Livestock and equipment should be removed from the flood plain immediately. Stay tuned to NOAA Weather radio or other news sources for further updates. Turn around, don`t drown when encountering flooded roads. Most flood deaths occur in vehicles. Additional information is available at www.weather.gov.

Today’s Forecast: More Heavy Rain Probable

According to Harris County Meteorologist Jeff Lindner, “…deep tropical moisture to the west will help create a series of upper level disturbances once again today. The result: scattered showers and thunderstorms that should begin with daytime heating. As a disturbance approaches the area this afternoon from the west, showers and thunderstorms will likely become slightly more organized.”

The air mass over the Lake Houston Area remains capable of heavy to excessive short term rainfall rates. Yesterday, 5-7 inches of rain fell over northeast Harris County in 4-5 hours. 8-12 inches fell over Austin County near Bellville.

Hourly rainfall rates of 2-3 inches per hour were common on Monday and the same air mass is in place today.

Rainfall today will likely average between 1-2 inches over the region, but isolated totals of 5-6 inches will be possible. Short range models indicate areas along and northwest of US 59 could be the prime location today for heavy rainfall. However, much of this will depend on:

  • Where storms develop
  • If and where any training develops
  • If any storms anchor in place.

Grounds are saturated from the recent rainfall. During the last 7 days, that rainfall has averaged 5-7 inches over much of the region with isolated totals of 10-14 inches.

Watersheds are already elevated this morning due to the recent rainfall and ongoing run-off over the area. Additional heavy rainfall will quickly run-off creating new rises.

Bens Branch at Kingwood Drive around 6PM on 5/24/21 after a 4-inch rain. Additional rains today, if heavy, could force creeks like this even higher.

Rapid onset flash flooding of streets and poor drainage areas will be the primary concern today, but should heavy rainfall impact already elevated and swollen watersheds some flooding would be possible. 

We should get a break from the rain Thursday and Friday, but more rainfall could enter the picture by this weekend, driving up rain chances yet again.

It’s been a wet month and will get wetter.

River and Lake Report

From Harris County Flood Warning System at 6:20 AM, 5.25.21.

In the upper right at the highest red icon, Peach Creek at FM2090 is three feet out of its banks. This area has flooded three times this month.

The yellow icon below it and to the right is the East Fork at FM2090. It is still two feet within its banks, but additional rainfall today could cause flooding.

The red icon at the northeastern tip of Harris County is the East Fork at FM1485. It is out of its banks again for the third time this month.

Lake Conroe is up about a half foot and releasing almost 1600 Cubic Feet Per Second.

As of 6:30 am on 5/25/2021

According to the Coastal Water Authority, Lake Houston is almost a foot and a half above normal and still releasing.

Four Halls Bayou Detention Ponds Recently Completed; Four More Virtually Done

If you saw the recent front page article in the Houston Chronicle about Halls Bayou, you would think that Harris County Flood Control District (HCFCD) relegated residents in the watershed to “the back of the bus.” Even before the bond, Halls received four floodwater retention projects, three of which are major. HCFCD is trying to expand the fourth of those. And since the flood bond, HCFCD has virtually completed four more floodwater retention projects..

Here’s what I found by simply driving around after consulting the HCFCD website and Google Earth Pro. I wish the Chronicle writer had done the same. There’s just no substitute for laying eyeballs on the job sites before riling up millions of people. Let’s start with the flood-bond projects first. I took all the photos below on 4/25/21 and 4/26/21.

Almost Completed Stormwater Detention Basins in Halls Watershed

West of Aldine Westfield, there’s a small basin owned by TxDOT. HCFCD hopes to enlarge this basin into the surrounding wooded areas as part of bond project C-25. Google Earth images show the first phase of this project was completed in 2012.

Funding “Shortfall” Not Yet Known

The Chronicle writer also claimed a “funding shortfall” for Halls of $272 million. Curious that he would make this statement just days before the GLO announces the winners of a statewide competition. Harris County could get some, none or all of its requests. To be clear, the competition is stiff; Harvey affected more than 40 counties. Regardless, there’s more than $2 billion up for grabs ($1 billion in this round and $1.144 billion in the next). It seems to me, the Chronicle writer could have waited a few days to publish results rather than rumors.

We Need Real Historical Data on Flood Mitigation Spending

Whether you agree with Rodney Ellis, Adrian Garcia and Lina Hidalgo or not, they have fought tenaciously for their constituents. They succeeded in reordering the priorities in flood-bond spending to serve low-to-moderate income neighborhoods first. For the Chronicle to imply that they failed their constituents is an insult to the Judge and Commissioners.

And to imply that all the money is going to more affluent neighborhoods is simply false. That claim seems designed to inflame racial hatred. Kingwood, for instance, has NEVER received one federally funded capital improvement project from HCFCD. Yet the Chronicle’s readers evidently concluded rich neighborhoods get all the money. Again, there’s no substitute for research.

In my opinion, we need facts, not fiction. Asserting discrimination is not the same as proving it.

Chronicle Article Also Ignores Tax Issue, Funding Realities

The Chronicle’s “HCFCD-puts-poor-people-at-the-back-of-the-bus” narrative also ignores the mechanics of funding projects. Before the flood bond vote in 2018, I spent an hour with former County Judge Ed Emmett discussing funding needs. A high priority at that point was to make local tax dollars stretch as far as they could by leveraging partner funding.

The need to leverage partner funding was even addressed in the final flood bond language. Paragraph 14 G states “…the commissioners court shall provide a process for the equitable expenditure of funds recognizing that project selection may have been affected in the past and may continue to be affected by eligibility requirements for matching Federal, State and other local government funds.”

Nobody stretches local tax dollars like the US Department of Housing and Urban Development (HUD). HUD is one of the main sources for funding projects in low-to-moderate income neighborhoods. Why?

HUD often offers a 90% match.

But there are two catches. First, you’re only eligible if at least 70% of residents that benefit from a project qualify as “low-to-moderate income” (LMI). Second, HUD is slow. To put “slow” in perspective, the Texas General Land Office just started accepting HUD grant applications from Imelda last Saturday. Imelda happened 586 days ago.

Looking at the flood bond spreadsheet (Page 6 of 10) and the expected partnership share of Halls Bayou Projects, you can see that 90/10 ratio reflected in most of the projected funding for Halls.

It’s unclear whether voters would have approved a flood bond that was 9X higher, especially when everyone, rich and poor alike, expressed concerns about not getting their fair share.

Alternative Sources of Halls Funding More Risky

Had HCFCD tried for FEMA funding instead, the low home values in Halls neighborhoods may have yielded a poor Benefit/Cost Ratio. Commissioner Ellis constantly reminds people about the perils of FEMA funding when applied to LMI neighborhoods.

So really, HCFCD had no choice but to focus on HUD for Halls projects.

  • The neighborhoods qualified.
  • The HUD match was far higher.
  • That minimized a tax increase.
  • It also maximized the number of possible Halls projects.

This was not a “gamble” as the Chronicle headline implied; it was actually the least risky option that seemed to benefit the most people.

We all need to calm down and wait to see how much money HUD grants the Hall’s Bayou Watershed projects. Brittany Eck of the GLO told me that she expects decisions by the end of this month. That’s this Friday.

Three More Major Projects on Greens Bayou Completed Recently by HCFCD, Army Corps

Tuesday, I posted about three Harris County Flood Control District (HCFCD) floodwater-detention projects in construction on Greens Bayou. But HCFCD and the Army Corps recently completed three more. All three in the latter category started in 2015 – before the flood bond.

Looking at all six (in construction + recently completed) helps one understand the magnitude of investment in this watershed during the last six years.

The combined cost of all six projects totals more than $222 million.

The map below shows the locations of the recently completed projects in black; those still in construction are red. This post will focus on #4, #5 and #6 below.

#4, #5 and #6 represent three projects started in 2015 and recently completed.

#4: Greens Bayou Federal Flood Risk Management Project

The Greens Bayou Federal Flood Risk Management Project, also known as the Antoine Stormwater Detention Basin, lies just east of the Cutten Basin, discussed Tuesday. The U.S. Army Corps of Engineers Galveston District (Corps) and Harris County Flood Control District broke ground in 2015. Phase I cost $58 million. Phase II cost $21.4 million. And channel improvements cost $5.7.

Phase I included approximately 3.7 miles of channel conveyance improvements from Cutten Road to Veterans Memorial Drive and approximately 108 acres of stormwater detention storage near the intersection of Antoine Drive and Beltway 8.

Phase II construction began in late 2016. It included completion of the north cell of the basin, located north of West Greens Road and excavation of the south cell, which is located south of West Greens Road.

The Corps designed and built the project. It also planted trees, shrubs, and grasses on disturbed areas. These features will improve stormwater quality, support wildlife and provide opportunities for recreational benefits.

West Greens Drive bisects the Antoine basin, dividing it into two parts. However, box culverts connect them and they function as a single detention pond. The completed basin holds approximately 1,650 acre-feet, or 538 million gallons of stormwater. To put that in perspective, it holds a foot of rain falling over a 2.5 square mile area, or half a foot falling across 5 square miles!

As part of a cost sharing arrangement, the Flood Control District purchased the 138-acre detention basin site. HCFCD also acquired other property and easements, and relocated utilities. The District will maintain the basin and channel in perpetuity.

#5: Kuykendahl Stormwater Detention Basin

Kuykendahl Stormwater Detention Basin sits on a 288-acre property near Kuykendahl Road and Ella Boulevard along an unnamed tributary of Greens Bayou.

The Kuykendahl Basin is the top purple area.

Contractors removed 3.61 million cubic yards of soil from the site. It holds 2,325 acre-feet, or 757.6 million gallons of stormwater. That’s a foot of rain falling across 3.6 square miles, or half a foot falling across 7.2.

Following construction, contractors planted 22.19 acres of native tree and shrubs, and 12.79 acres of stormwater quality-treatment wetlands. They also created 14.04 acres of other wetlands to replace those impacted by construction.

Native, woody, riparian vegetation stabilizes banks, shades water, and creates habitat for birds.

FEMA awarded $39.2 million to the Harris County Flood Control District, under the Hurricane Ike Hazard Mitigation Grant Program (HMGP), for construction of this and another stormwater detention basin (see #6 below). The Flood Control District contributed matching funds for both projects. 

Ceres Environmental Services Inc. constructed the two basins for $63.7 million. Combined, they were the largest construction contract ever managed by the Flood Control District up to that time. The two basins reduced or removed flooding risks and damages from more than 1,100 structures along Greens Bayou. “Avoided damage” exceeds $90 million in every flood. 

Both projects (#5 and #6) are part of Progress Greens, a suite of flood damage reduction projects in the Greens Bayou watershed. All projects under the Progress Greens umbrella will function together to reduce flooding risks and damages for residents and businesses within the 213 square miles of the Greens Bayou watershed.

#6: Glen Forest Stormwater Detention Basin

The Glen Forest Stormwater Detention Basin lies southeast of the Kuykendahl Basin on a 160-acre site east of Interstate 45 and slightly north of Beltway 8. See P500-08-00 in the map below.

The Glen Forest project is at the purple location on the right.

The Glen Forest Basin project removed approximately 2.15 million cubic yards of soil in three connected cells. The completed basin holds approximately 894 acre-feet, or 291.3 million gallons of stormwater. That’s 1.4 square miles one foot deep or 2.8 square miles a half foot deep.

Basin design included 2.75 acres of native tree and shrub plantings and 0.81 acres of stormwater quality treatment wetlands.

Regulation Vs. Mitigation

Areas both up and downstream from these ponds have extremely high-density commercial, industrial and residential development. Drive up Kuykendahl or Imperial Valley, for instance, and you will find mile after mile of apartment complexes. There’s little room for water to soak in during rainstorms.

More sensible development regulations that mandated onsite detention ponds when this area was being built might have prevented a lot of flood damage and heartbreak. Mitigating flood issues is always far more expensive, difficult and time consuming than preventing them. And many times, mitigating them after the fact is not even possible because of the shortage of land.

Value of Coalitions and Cooperation

Projects like the three above don’t happen without the combined efforts of elected representatives at the county, city, state and federal levels, plus community groups such as the Greens Bayou Coalition (GBC).

According to Jill Boullion, former director of the GBC, “The GBC advocated for $55 million in USACE funding from 2009 to 2015 for the Antoine Basin (Project #4) alone. We made many trips to DC, Galveston and Dallas to meet with elected officials, US Army Corps, Office of Management and Budget, and others. The Obama administration finally approved the funding! That was my first advocacy project and, boy, did I learn a LOT!!!”

The moral of that story: never underestimate the value of coalitions and cooperation in moving these projects forward.

Construction of HCFCD Greens Bayou Flood Mitigation Projects in High Gear

One of the largest watersheds in northern Harris County is Greens Bayou. It drains 212 square miles with a population of more than half a million people. It encompasses portions of the cities of Houston and Humble.

Greens Bayou and its tributaries have flooded homes and businesses numerous times in the last two decades. Tropical Storm Allison in 2001 and Hurricane Harvey in 2017 produced devastating floods thanks to large floodplains and high-density development.

An Equity Priority

As a result of high percentages of low-to-moderate income neighborhoods as you work your way east and south along the bayou, flooding in Greens received a high priority in the Harris County’s Equity Prioritization Framework.

Harris County Flood Control District currently has three projects in construction along Greens Bayou with more on the way. One of the three is virtually complete. When I photographed it today, I found contractors doing a final inspection. Here’s a rundown of current and future projects.

Greens Bayou runs roughly parallel with the North Belt before turning south and eventually joining Buffalo Bayou. Projects 1 and 3 are large scale detention projects under construction. Phase 1 of Project 2 is virtually complete.

Project #1: Cutten Stormwater Detention Basin

HCFCD is currently excavating a massive 235-acre stormwater detention basin near Cutten Road and State Highway 249. It will reduce flooding risks in the Greens Bayou watershed by taking in excess stormwater during heavy rain events and then releasing it slowly back to the bayou when the threat of flooding has passed.

The project is budgeted at $16.2 million. And it is approximately one-quarter complete. I took the pictures below on 4/20/21.

Project #2: Aldine Westfield Stormwater Detention Basin

Further down the bayou, the Aldine Westfield Stormwater Detention Basin is located just north of Beltway 8 and east of Aldine Westfield Road. The first phase of this project is virtually complete. It sits in a no-fly zone for drones because of its proximity to Bush Intercontinental Airport. So you will have to make do with a ground-level construction photo stitched together in Photoshop from five separate exposures.

South and north segments are being constructed in two phases because of environmental permitting. Eventually, the two basin compartments will connect via a 48-inch pipe and will outfall into Greens Bayou.

The first phase above cost $7.7 million. The second will cost $11.3 million.

HCFCD

Because of the location just south of Bush Intercontinental Airport, this basin will not have a permanent pool. Reason: to avoid attracting waterfowl which could create a hazard to aviation.

The two basins will eventually hold approximately 1,250 acre-feet, or more than 407.3 million gallons, of stormwater that otherwise might flood homes and businesses during heavy rain events. The benefits of this project are best understood as part of a suite of projects – Progress Greens – that will work together to reduce flooding risks within the 213 square miles of the Greens Bayou watershed.

Part of Project Greens

Project Greens is a suite of flood damage reduction projects. The Harris County Flood Control District is taking the lead in some, with grant assistance from the Federal Emergency Management Agency (FEMA). In others, the U.S. Army Corps of Engineers will design and construct the project, with partnership assistance from the Flood Control District. 

All projects under the Progress Greens umbrella will function together to reduce flooding risks and damages for residents and businesses within the 213 square miles of the Greens Bayou watershed.

The Aldine Westfield Stormwater Detention Basin project is and will be funded both through the Flood Control District’s Capital Improvements Program and the 2018 Bond Program. If partnership funds are not available, the project will be funded totally from the 2018 Bond Program as a “Local Only” project.

Project #3: Lauder Stormwater Detention Basin

The Lauder Stormwater Detention basin is another 2-phase project. Phase One, just north of Lauder Road and west of JFK Boulevard, will cost $18 million when complete. Phase Two will cost another $20.5 million and be located west of Phase One in parts of the Castlewood subdivision which HCFCD has bought out. Harris County Commissioners Court accepted the Preliminary Engineering Report and authorized the design and construction of Phase Two of the stormwater detention basin.

The photos below show the status of Phase One.

When complete, the Lauder Stormwater Detention Basin will hold at least 1,200 acre-feet, or more than 391 million gallons of excess stormwater. According to HCFCD, the project will reduce risk in more common 10 percent (10-year) floods, but would be overwhelmed in a much larger storm.

While driving around this area, I noticed a new home ten-feet up on stilts, while older homes sat at ground level. Commercial and industrial development around Bush Intercontinental Airport has literally swamped this area. This Lauder Basin is also part of Progress Greens.

The Lauder Stormwater Detention Basin project is being funded both through the Flood Control District’s Capital Improvements Program (for design) and through the 2018 Bond Program (for construction).

Total Cost for Greens Bayou Projects in Construction

Altogether, construction of these three projects will cost approximately $42 million. Phase Two of Aldine Westfield and Lauder basins will cost another $31.8 for a total of almost $74 million. Phase 2 of the Aldine Westfield construction will kick off this summer. And Phase 2 of the Lauder project will start next winter.

HCFCD Completes Removal of Another 10,000 Cubic Yards From Bens Branch

Harris County Flood Control District (HCFCD) contractors have completed removal of virtually another 10,000 cubic yards of sediment that had accumulated in Bens Branch between Rocky Woods Drive and Kingwood Drive. While a little cleanup work and equipment removal remains, we can call this job “well done.”

Scope of Work Completed

HCFCD widened and deepened half mile stretch of the creek/ditch. Flood Control also re-sloped the banks, straightened the flow lines, replaced backslope interceptor drains, restored the original conveyance of the ditch, and replanted grass.

Tens of Millions in Nearby Damages during Harvey

During Harvey, dozens of homes flooded along both sides of this channelized stream. So did Kingwood High School and the old H-E-B shopping center north of Kingwood Drive. The shopping center is still mostly vacant because of flood damage. And the Humble ISD spent $70 million to restore Kingwood High School which flooded to the second floor.

Approximately 1000 Truckloads of Sediment Removed

Given that your average dump truck holds about 10 cubic yards, contractors removed about a 1000 truckloads of sediment during this phase of the Bens Branch project.

While the truck traffic got intense at times, contractors finished months ahead of schedule. They originally scheduled completion for early July.

Before/After Photo Essay

The first photo below was taken in January before the start of the project. I shot the rest on April 16.

Bens Branch at Rocky Woods after completion of project on April 16, 2021. The greenish tinge on the slopes is hydro mulch. Hydro mulch is grass seed embedded in a gelatin which can be sprayed on the slopes. Nutrients in the gelatin help ensure that grass will begin to grow in the least amount of time possible, hopefully before heavy rains can erode the slopes.
In fact, new grass shoots are already poking out of this ground. This new drain at Laurel Garden replaces one that had collapsed and become almost totally blocked. The average service life of galvanized corrugated metal pipe is up to 40 years.

Note the warning. Waste dumped in these drains blocks them and contributes to neighborhood flooding. Even if waste does not block the drain, it can wind up in Lake Houston or Galveston Bay.

No More Bens Branch Projects Scheduled At This Time

This was the fourth and final phase of Bens Branch restoration. Previous projects addressed Bens Branch from:

HCFCD says it has no plans at this time to address the portion from the Y to the West Fork near Kings Harbor.

No one can guarantee that this work will prevent a future flood, but it will certainly make one less likely.

Thanks to the women and men of HCFCD and their contractors who kept the Bens Branch project moving through the pandemic. And to the US Department of Agriculture’s National Resources Conservation Service which provided partial funding.

Thanks also to the Bear Branch Trail Association, Kingwood Service Association and Kings Forest CA. All helped provide access to the project area across their property.

Onward to other projects such as Woodridge Village Detention, Taylor Gully restoration, and Diversion Ditch expansion. More on those in future posts.
